Terms and Conditions & Agreement Forming Part of the Distributor’s Application

• I confirm complete the range of 18 as on date of the application hereby submitted
• I have gone through the Terms & Conditions and Rules & Regulations, also the Business. Plan made available to me by my sponsor before signing this application. On acceptance of my application for becoming an “Authorized Independent Business Owner”. I shall abide by all these Terms & Conditions and Rules & Regulation as amended by the company from time to time.
• While signing this application from I am aware that I have to pay enrollment fee and also purchase the company products for my own/family use.
• I hereby declare that I have no business interest in any other Multi Level marketing (or Network marketing) companies directly or indirectly and to no have financial interest in more than one independent Business Ownership
• My spouse and I shall not apply for separate distributorship of the company.
• I am aware that my Distributorship of the company cannot be sold, assigned or transferred to any person(s) or organization without the prior written consent of the company.
• I undertake to work only as an authorized independent Business Owner of the company.
• I shall not act as an Authorized Agent of Employee of the company nor stake any such claim to the company.
• I also understand that in the conduct of the Business I have no implied, extensible or express authority to make any implied or express representation or warranty on behalf of the company during the period of Authorized Independent Business Ownership. I am only authorized to purchase and sell the product of the company by way or Retail Sales in accordance with conditions stipulated by the company in the business schedule and a prescribed from time to time.
• As an Authorized Independent Business Owner I shall not do any act which will tantamount to violation/contravention of any of the existing statutory regulations/provisions, enactment or laws in India, or as amended from time to time.
• I agree to maintain a pragmatic marketing system and to company with any charge in the law of the land. The company shall be entitled to after amend modify or delete the various classes in the Business Schedule as and when felt necessary and I agree to abide by all these amendments from time to time
• I shall not make any statement, representation, claims or warranties regarding the company or its product save as those published by the company in the from of brochures and other printed material.
• I shall agree to the obligation to use only those promotional materials published by the company. These is not exception and only the English version will be taken as the official copy.
• I shall agree to the obligation to provide bonafide retailing and supervising function supplying/servicing customer and Distributors personally sponsored while endeavoring to introduce the products/the marketing plan or Tele marketing.
• I undertake not to promote/sell any products/service not approved by the company through the company’s Net Work or Distributors.
• I also undertake not to market the company products at prices lower than what is prescribed by the company.
• I abide by the company’s stipulation that repacking of the company’s product is strictly forbidden.
• I agree that in case any product is out of stock temporarily this will be booked as “back order” and will be supplied as and when stock are received. The purchase will be booked in the month in which the order is placed.
• Retail purchase leads as and when received will be referred by the company to distributors. The company will however make every effort possible interest. The company reserves the right to refer such Leader to any distributor who is at level of Silver executive and above. Allotting the neutral lead is entirely the prerogative and at the discretion of the company.
• I shall not, as a Distributor, solicit or sponsor any employee of the company of their family to be a distributor.
• If for any reason, I decide to discontinue my distributorship I undertake to submit resignation at any time by giving 30 days notice to the Company, and I shall not claim any refund whatsoever.
• The re-admission of resigned/terminated Distributor will be solely at the discretion of the company.
• I authorize the company to maintain and transmit the data on my application form in any manner the company, deems it fit.
• I accept that Bonus if any Due will be paid by the company, unless there is Court Order prohibiting or restricting such payments.
• I Accept that the company, is bound to deduct income Tax at source from the payments to be made to me every month, as per the income Tax Act 1961 at the rates prescribed from time to time.
• I accept that I am responsible to pay taxes as applicable. The company should proved the monthly Bonus Cheques and Annual income Statement as required by law.
• As a distributor I shall not make any medical claims for any the company products or suggest the companys products as suitable for the treatment/cure for any specific aliment or liken to/compare them with the Drug products prescribed medically.
• If I am found to have acted in breach of the terms and conditions and/or have caused any loss or damage to the company, in any manner whatever. The company, shall be entitled to terminate my distributorship forth without any compensation to me and shall also be entitled to resort to legal proceedings to claim a full and complete indemnity from me by way of damages.
• It is also understood that neither the company, nor its distributor will be held responsible for delays in performance due to circumstances beyond the the control of the parties.
• This agreements constiutes all the covenant between me, as distributor and the company, and no other representations promise, guarantees or agreement of any means shall be valid unless given in writing by the company.
• This agreement shall be governed by the laws of the country and all claims, disputes and other matters between parties to this agreement shall be brought to the appropriate out of law at Allahabad Jurisdiction.
• In the event of any dispute arising between the distributor & the company, relating to any matter concerned with this appointment or the subject thereof or in relation thereto and whether as to the construction or otherwise, the same shall be referred for Arbitration under the Arbitration and Conciliation Act. 1996 one shall be final & binding on both the parties. The venue of arbitration shall be subject to Allahabad Jurisdiction.
• The company, is at liberty to amend remove or modify the Term and Conditions and when considered necessary notified and can be taken as accepted me unless disputed.
• I hereby accept and confirm that I have read and understand the terms and conditions contained in this agreement.
